From deed book C page.328 Cumberland County, KY, records:

KNOW ALI, MEN BY THESE PRESENT6 THAT WE SAMUEL BIGGERSTAFF and Mary Biggerstaff, late Mary Mays widow and relict of William Mays, deceased of the County of Cumberland and State of Kentucky, for and in consideration of making a final settlement of the legatees of the said William Mays,deceased, and in consideration of certain personal property put into our possession and in conjunction with my present husband I and himself do do hereby agree that the said Legetees, namely, Thomas Johnson and Joamia, his wife, formerly Joami Mays, Froederick Mays, Moses Cook and Mary, his wife, formerly Mary Mays, James McCarty and Sarah, his wife, formerly Sarah Mays, William Mays, and Susannah, his wife, daughter of said William Mays, deceased, shall sell and dispose of all the tract of land which was the property of the said William Mays, deceased, lying on the water of Marrowbone, in the county and state aforesaid, and contain whatever may be included in the lines after Pierce Wade's land is taken out of the same it being originally a grant for 200 acres, and we, the said Samuel Biggerstaff and Mary, his wife for ourselves and heirs do hereby relinquish and quit claim to all and every part of said land, either under the will of my former husband or whatever may be coming to me by the laws of the Common wealth, provided should the will be broken, and the said Samuel Biggerstaff do also join the same, hereby ratifying the whole and the said Biggerstaff do for myself my heirs and hereby forever quit claim to all and every part of the Dowery wright, of my present wife in and to the same; she and myself conjointly having hereto agreed the pecuniary lagacies given to Sarah McCarty and Mary Cook in the will of the said Mays deceased, are herein accepted and to be fully complied with. Deed book C page 329 has a power of attorney from Frederick May of Claybourn Co., Tenn., appointing Thomas Johnson of Cumberland Co., Ky. to collect his share of the estate.
